Prospective Marriage Visa (Subclass 300)
The Prospective Marriage Visa (Subclass 300) is designed for engaged couples who wish to reunite in Australia. This visa allows you to enter Australia with the intention of marrying your partner within nine months. After marriage, you can then apply for a Partner Visa to stay in Australia permanently.
Key Information:
- Applicants must be outside Australia when applying for and when granted the visa.
- You and your sponsor must have met in person.
- If you and your sponsor marry during the processing of your Prospective Marriage Visa application, the application can be transitioned to a Partner Visa.
Partner Visa (Subclasses 309, 100, 820, 801)
The Partner Visa allows Australian citizens, permanent residents, or eligible New Zealand citizens to sponsor their married or de facto partners, or fiancés, to live in Australia permanently.
Key Information:
- The visa process is divided into two stages: an initial temporary partner visa (subclasses 820 and 309) followed by a permanent visa stage (subclasses 801 and 100).
- Applicants must be sponsored by an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Evidence must be provided to demonstrate that the relationship is genuine and ongoing.
A Partner Visa allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. It is granted in two stages: a temporary visa followed by a permanent visa.
There are five main subclasses for Partner Visas:
- Subclass 300: For partners who are engaged and intend to marry in Australia. Must be applied from outside Australia.
- Subclass 309: For partners applying from outside Australia.
- Subclass 100: For those transitioning from the Subclass 309 to permanent residency.
- Subclass 820: For partners applying from within Australia.
- Subclass 801: For those transitioning from the Subclass 820 to permanent residency.
To be eligible, you must:
- Be the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen.
- Provide evidence that your relationship is genuine and ongoing.
- Meet health and character requirements.

- Nature of Household
- Nature of commitment
Processing times can vary, but generally:
- Subclass 820/309: Approximately 12 to 18 months.
Subclass 801/100: An additional 12 to 24 months after the temporary visa
Yes, you can apply for the Partner Visa (Subclass 820) if you are already in Australia. If you are applying from outside Australia, you should apply for the Subclass 309.
If you marry while your Prospective Marriage Visa application is being processed, your application may be transferred to a Partner Visa (Subclass 820/801) if eligible.
Yes, if granted a temporary Partner Visa (Subclass 820 or 309), you can live together in Australia while waiting for your permanent residency decision.
